1. Dati Societari e Applicabilità
I presenti Termini di Servizio ("ToS") e l'Accordo sul Trattamento dei Dati ("DPA") regolano la fornitura dei servizi di hosting erogati da 9365-0596 Québec inc. (di seguito "KeepIn Hosting", "Società" o "Fornitore"), con sede legale in 1260 Rue Belanger suite #200, H2S 1H9 Montreal, QC, Canada.
L'accettazione dei presenti termini avviene con l'acquisto o l'utilizzo di qualsiasi servizio di KeepIn Hosting. Per le questioni legali non coperte dal regolamento GDPR, si applicano le leggi della Provincia del Québec e le leggi federali del Canada ad esse applicabili. Per qualsiasi controversia, il foro esclusivamente competente è il Tribunale di Montréal, Québec (Canada).
2. Livello di Servizio (SLA) e Backup
- Uptime Garantito: KeepIn Hosting garantisce una disponibilità della rete e dell'infrastruttura di hosting del 99% su base annua. Sono escluse dalla garanzia le finestre di manutenzione programmata e le cause di forza maggiore.
- Infrastruttura Data Center: I server e l'infrastruttura fisica di hosting sono localizzati all'interno dell'Unione Europea, presso i data center Hetzner in Germania e Finlandia.
- Politica di Backup: KeepIn Hosting esegue backup automatici dei dati dei clienti con la seguente politica di ritenzione:
- 1 copia giornaliera (ultime 24 ore);
- 1 copia settimanale (relativa al lunedì precedente);
- 1 copia mensile (relativa al giorno 31 del mese precedente).
3. Diritto di Recesso, Rimborsi e Registrazione Domini
- Garanzia di Rimborso 30 Giorni: I servizi di web hosting godono di una politica "soddisfatti o rimborsati" entro 30 giorni solari dalla data del primo acquisto.
- Registrazione e Rinnovo Domini: La garanzia di rimborso non si applica ai nomi di dominio. I domini registrati o trasferiti tramite KeepIn Hosting sono soggetti a un pagamento minimo non rimborsabile valido per 1 intero anno e sono regolati dalle rispettive Authority (ICANN, EURid, Naming Authority, ecc.).
4. Politica di Uso Consentito (AUP)
È rigorosamente vietato utilizzare i servizi di KeepIn Hosting per le seguenti attività:
- Streaming Pirata e Violazione del Copyright: Distribuzione o streaming non autorizzato di materiali protetti da copyright.
- Attacchi Informatici: Esecuzione o facilitazione di attacchi DDoS, port scanning, malware, botnet, ransomware o qualsiasi attività atta a violare la sicurezza di reti e sistemi altrui.
- Spamming: Invio non autorizzato di email di massa (SPAM), utilizzo di mailer non sicuri o attività che comportino l'inserimento degli IP di KeepIn Hosting nelle blacklist internazionali.
- Contenuti Illegali e Lesivi: Diffusione di contenuti diffamatori, minatori, atti ad offendere o arrecare danno a persone, aziende, istituzioni, o che violino le norme vigenti in materia di protezione dei minori e diritti umani.
La violazione della presente AUP comporta la sospensione o risoluzione immediata del servizio senza alcun diritto di rimborso.
5. Accordo sul Trattamento dei Dati (DPA - Art. 28 GDPR & PIPEDA)
5.1 Ruoli delle Parti
Ai sensi del Regolamento (UE) 2016/679 (GDPR):
- Il Cliente agisce in qualità di Titolare del Trattamento (Data Controller) dei dati personali immagazzinati o elaborati tramite il servizio di hosting.
- KeepIn Hosting agisce in qualità di Responsabile del Trattamento (Data Processor).
5.2 Ubicazione dei Dati e Trasferimento Internazionale (UE - Canada)
- Storage Locale UE: I dati personali del Cliente risiedono e sono elaborati fisicamente all'interno dei data center stabiliti nell'Unione Europea (Germania e Finlandia).
- Adeguatezza PIPEDA: Poiché la Società ha sede in Québec (Canada), qualsiasi trasferimento o accesso amministrativo necessario erogato dal Canada è pienamente legittimato dalla Decisione di Adeguatezza della Commissione Europea (Art. 45 GDPR) relativa alla legge federale canadese PIPEDA (Personal Information Protection and Electronic Documents Act). Non sono richieste Clausole Contrattuali Tipo (SCC) aggiuntive, salva diversa richiesta scritta specifica del Cliente.
5.3 Sub-responsabili del Trattamento (Sub-processors)
Il Cliente autorizza espressamente l'uso del seguente sub-responsabile di infrastruttura hardware e data center:
- Hetzner Online GmbH (Germania / Finlandia) – Fornitura di infrastruttura server e data center.
5.4 Obblighi di Sicurezza e Data Breach
KeepIn Hosting adotta misure tecniche e organizzative idonee a garantire la riservatezza, l'integrità e la disponibilità dei dati. In caso di violazione dei dati personali (Data Breach) che coinvolga l'infrastruttura del Cliente, KeepIn Hosting notificherà il Cliente senza indebito ritardo ed entro e non oltre 48 ore dal rilevamento dell'evento.
Terms of Service (ToS) & Data Processing Agreement (DPA - Art. 28 GDPR)
1. Corporate Details & Jurisdiction
These Terms of Service ("ToS") and Data Processing Agreement ("DPA") govern the provision of hosting services provided by 9365-0596 Québec inc. (hereinafter "KeepIn Hosting", "Company", or "Provider"), having its registered office at 1260 Rue Belanger suite #200, H2S 1H9 Montreal, QC, Canada.
By purchasing or using any KeepIn Hosting service, the Client agrees to these terms. For legal matters not governed by GDPR regulations, the laws of the Province of Québec and the federal laws of Canada applicable therein shall apply. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the Courts of the District of Montreal, Québec (Canada).
2. Service Level Agreement (SLA) & Backups
- Uptime Guarantee: KeepIn Hosting guarantees network and infrastructure availability of 99% on an annual basis. Scheduled maintenance windows and force majeure events are excluded from this guarantee.
- Data Center Infrastructure: Servers and physical hosting infrastructure are located inside the European Union, at Hetzner data centers in Germany and Finland.
- Backup Policy: KeepIn Hosting performs automated backups with the following retention cycle:
- 1 daily backup (last 24 hours);
- 1 weekly backup (from the previous Monday);
- 1 monthly backup (from the 31st day of the previous month).
3. Right of Withdrawal, Refunds & Domain Names
- 30-Day Money-Back Guarantee: Web hosting services are backed by a 30-day money-back guarantee starting from the initial purchase date.
- Domain Registration & Renewal: The money-back guarantee does not apply to domain names. Registered or transferred domains require a non-refundable minimum term payment of 1 full year and are governed by their respective domain registries (ICANN, EURid, Naming Authorities, etc.).
4. Acceptable Use Policy (AUP)
Using KeepIn Hosting services for any of the following activities is strictly prohibited:
- Pirated Streaming & Copyright Infringement: Unauthorized streaming, hosting, or linking to copyrighted material.
- Cyberattacks: Launching or facilitating DDoS attacks, port scanning, malware distribution, botnets, ransomware, or any activity compromising network security.
- Spamming: Sending unsolicited bulk emails (SPAM), running unauthenticated mail relays, or causing Provider IP addresses to be blacklisted.
- Abusive or Illegal Content: Hosting defamatory, harassing, or threatening material, or any content intended to offend, harm, or damage individuals, corporations, or public institutions.
Violation of this AUP will result in immediate suspension or termination of service without entitlement to a refund.
5. Data Processing Agreement (DPA - Art. 28 GDPR & PIPEDA)
5.1 Roles of the Parties
Under Regulation (EU) 2016/679 (GDPR):
- The Client acts as the Data Controller for all personal data hosted or processed via the service.
- KeepIn Hosting acts as the Data Processor.
5.2 Data Location & International Transfers (EU - Canada)
- Local EU Storage: Client personal data strictly resides and is processed within data centers located in the European Union (Germany and Finland).
- PIPEDA Adequacy: Because the Company is registered in Québec (Canada), any administrative access or transfers from Canada are fully lawful under the European Commission's Adequacy Decision (Art. 45 GDPR) recognizing the Canadian federal law PIPEDA (Personal Information Protection and Electronic Documents Act). Additional Standard Contractual Clauses (SCCs) are not required unless specifically requested by the Client in writing.
5.3 Sub-processors
The Client expressly authorizes the engagement of the following infrastructure sub-processor:
- Hetzner Online GmbH (Germany / Finland) – Dedicated server and data center infrastructure provider.
5.4 Security & Data Breach Notification
KeepIn Hosting implements appropriate technical and organizational measures to ensure data confidentiality, integrity, and availability. In the event of a Personal Data Breach affecting Client data, KeepIn Hosting will notify the Client without undue delay and no later than 48 hours after becoming aware of the incident.
